Trekplan — End User Licence Agreement ======================================= NOT LEGAL ADVICE. This agreement was drafted to be fair, plain and consistent with the way Trekplan is actually sold and how it actually behaves. It has not been reviewed by an attorney. South African consumer sales are governed by the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, which give buyers rights that no agreement can take away. This document is written to work WITH those laws rather than pretend to override them, but if you expect meaningful revenue, have it checked once by someone qualified. Version 1.0 — effective 8 August 2026 Vendor: Corné Fick t/a Trekplan ("we", "us"), South Africa. Contact: support@trekplan.co.za THE SHORT VERSION (this summary is for convenience; the numbered terms below govern) * Buy once, use it forever. One person, up to three of your own computers. * Everything Trekplan produces is yours. We claim nothing over your data or plans. * Not happy? Full refund within 14 days, no reason needed. * Bug fixes are free for as long as we maintain this version. * Enter your licence key once per computer; there is a 14-day trial before that. The check happens on your machine and never contacts us. * Trekplan plans routes; it does not replace your judgement. Check a plan before you send people and vehicles out on it. * It runs on your computer. Nothing about your sites is uploaded unless you switch on "Real roads". The only other network call is a version check at startup, which sends nothing about you and can be turned off. 1. WHO THIS AGREEMENT IS BETWEEN 1.1 This agreement is between you and us, and covers your USE of Trekplan (the "Software"). 1.2 If you bought through an online store such as Gumroad, Payhip or Paddle, that store is the seller of record for the PURCHASE itself. Their terms govern payment, invoicing and tax, and they may operate their own refund process. Clause 5 tells you how our refund promise works alongside that. 1.3 By installing or using the Software you accept this agreement. If you do not accept it, do not install it, and ask for a refund under clause 5. 2. WHAT YOU MAY DO 2.1 We grant you a personal, non-exclusive, non-transferable, perpetual licence to use the Software for your own business or personal purposes. 2.2 One licence covers ONE named user on up to THREE computers that you own or control (for example a desktop, a laptop and a home machine). If several people will use Trekplan, please buy a licence for each of them. 2.3 The licence does not expire. If we ever stop selling or supporting Trekplan, the copy you have keeps working. 2.4 YOUR LICENCE KEY. When you buy, we send you a licence key. You enter it once per computer under Help > Enter licence... Before a key is entered the Software runs as a fully-featured 14-day trial, so you can start work immediately; after that it asks for the key before generating a plan. The check is performed entirely on your own computer and never contacts us, so it keeps working offline, in the field, and if we disappear. Losing the key does not cost you the licence — write to us and we will resend it. 2.5 The three-computer limit in clause 2.2 is not enforced by the Software. We have deliberately not built anything that phones home or counts your machines, because it would fail you on the day your signal is poor. We are trusting you to keep to it, and we would rather ask than police. 2.6 YOUR DATA IS YOURS. Your input files, and every route plan, spreadsheet and map file Trekplan produces, belong to you. We claim no ownership, no licence and no rights over them, and we never see them (see clause 9). 3. WHAT YOU MAY NOT DO 3.1 You may not resell, rent, lease, sublicense, publish or otherwise redistribute the Software itself, or share your copy with people outside clause 2.2. 3.2 You may not remove, obscure or alter any copyright, licence or attribution notice in the Software or in the accompanying "licenses" folder. 3.3 You may not attempt to defeat any current or future licensing mechanism. 3.4 You may not reverse-engineer, decompile or disassemble the Software, EXCEPT (a) to the extent that restriction is prohibited by law, and (b) as expressly permitted by clause 4 in respect of the open-source components. 4. OPEN-SOURCE COMPONENTS 4.1 Trekplan includes third-party open-source software. Each component and its licence is listed in the "licenses" folder supplied with the Software, and is also reachable from Help → About → Open licences. 4.2 Those components are licensed to you under their OWN terms, which PREVAIL over this agreement wherever the two conflict. Nothing in clause 3 limits any right those licences give you. 4.3 In particular, the Qt libraries (PySide6) are used under the GNU Lesser General Public Licence version 3. They are dynamically linked, and you are entitled to modify them and relink the Software against your modified version. The method is described in licenses/THIRD-PARTY-NOTICES.txt. Ask us at support@trekplan.co.za if you need help exercising that right. 5. REFUNDS 5.1 If Trekplan is not right for you, tell us within 14 days of purchase and you get a full refund. You do not have to give a reason, and you do not have to justify it. 5.2 If you bought through a store (clause 1.2), the refund is normally processed by that store. If the store declines or delays a request that meets clause 5.1, contact us at support@trekplan.co.za and we will make it right. 5.3 Clause 5.1 is our own promise and is in addition to — not instead of — any cooling-off or cancellation right you have by law. 6. UPDATES AND SUPPORT 6.1 Bug-fix updates for the version you bought are free, for as long as we maintain that version. 6.2 A future major version with significant new features may be a separate paid product. If so, your existing licence keeps working; you are simply not obliged to upgrade. 6.3 Support is by email at support@trekplan.co.za, on a best-effort basis. We are a small operation and do not promise a specific response time. We will tell you honestly if something you have reported is not going to be fixed. 6.4 So that you hear about a fix, the Software asks our website at startup whether a newer version exists, and tells you if so. It sends nothing about you — see clause 9.3 — and you can switch it off under Help. 6.5 If a run fails, Trekplan writes an error log into your output folder (_error.log, or _cli_error.log when run from the command line). Sending that file with your question is the fastest route to an answer. 7. WARRANTIES, AND YOUR RIGHTS THAT CANNOT BE SIGNED AWAY 7.1 We have taken real care with this Software: it ships with an automated test suite and has been checked against real-world data. Even so, no software is free of defects, and the Software is provided "as is". 7.2 To the maximum extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. 7.3 NOTHING in this agreement excludes, limits or waives any right you have under a law that cannot be excluded by agreement — including the Consumer Protection Act 68 of 2008 where it applies to you. Where any part of this agreement conflicts with such a law, that law wins and the rest of this agreement still stands. 8. PLANNING OUTPUT IS ADVISORY — PLEASE READ THIS ONE 8.1 Trekplan groups points into routes and ESTIMATES travel distance. Unless you switch on the optional "Real roads" feature, distances are straight-line estimates multiplied by a road factor, and are not actual driving distances. 8.2 Even with "Real roads" enabled, the figures exclude traffic, roadworks, closures, tolls, terrain, vehicle restrictions, site access conditions, weather, driver hours and rest requirements. 8.3 A Trekplan plan is a PLANNING AID, not an instruction to a driver. You remain responsible for reviewing any plan before dispatching people or vehicles, and for complying with road traffic, occupational health and safety, and working-time law. 8.4 To the maximum extent the law allows, we are not liable for fuel, labour, vehicle, scheduling, contractual or other business losses arising from reliance on the Software's output, and our total liability for any claim connected to the Software is limited to the amount you paid for it. 8.5 Clause 8.4 does NOT limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. 9. PRIVACY AND NETWORK USE 9.1 Trekplan runs on your computer. It contains no analytics, no telemetry and no licence phone-home — your licence key is checked entirely offline. The Software makes exactly TWO network connections, both described below, and no others. You can switch either of them off. 9.2 If you choose the optional "Real roads" distance basis, the Software sends your site COORDINATES and the OpenRouteService API key that you supply to openrouteservice.org, in order to look up driving distances. That is the only data about your sites that ever leaves your computer. Your site names, IDs, regions, input files and output files are never transmitted. If your coordinates are confidential, use the straight-line estimate instead. This feature is off unless you turn it on. 9.3 At startup the Software asks https://trekplan.co.za whether a newer version of Trekplan exists, and tells you if one does. This request sends nothing about you, your computer, your licence or your sites — it only asks the question. It never runs when the Software is used from the command line. You can switch it off under Help > Check for updates at startup, after which it does not run at all. 9.4 Your settings are stored on your own computer at %LOCALAPPDATA%\Trekplan\settings.json. Any OpenRouteService key you enter is stored there ENCRYPTED, using Windows' own Data Protection API, so that it can be decrypted only by your Windows account on that machine. That also means copying the file to another computer or user account will not carry the key across. Delete the file to clear the stored key and reset the Software to its defaults. 9.5 We do not collect, receive or process any personal information about you through the Software. If you email us for support, we use your address only to answer you. 10. IF THIS AGREEMENT ENDS 10.1 This licence ends automatically if you materially breach it and do not put the breach right within 14 days of us asking you to. 10.2 On termination you must stop using the Software and delete your copies. Plans and files you have already produced remain yours to keep and use (clause 2.6). 11. GOVERNING LAW 11.1 This agreement is governed by the law of the Republic of South Africa, and the parties submit to the non-exclusive jurisdiction of its courts. If you bought as a consumer elsewhere, this does not deprive you of the protection of mandatory consumer law where you live. 11.2 If any provision is found unenforceable, it is severed and the remainder continues in force. 12. CHANGES AND ENTIRE AGREEMENT 12.1 We may publish a revised agreement for FUTURE purchases. The version supplied with your copy is the one that governs your licence; we cannot change your terms after you have bought. 12.2 This agreement, together with the third-party notices in the "licenses" folder, is the entire agreement between you and us about the Software, and replaces any earlier discussion or marketing statement.
